BRIEF AND CONCLUSIONS. <br /> <br />'I. STATUTORY REQUIREMENTS <br /> <br />Pursuant to Colorado revised statutes Chapter 36 Article 20 Section <br />112 the requirements for a permit are set forth as follows: <br /> <br />A. PRE HEARING REQUIREMENTS <br /> <br />The act provides that the director shall issue a weather <br />modification permit to a corporation, provided that the applicant <br />does the following: <br /> <br />a. The person in control holds a valid weather modification <br />license. <br /> <br />b. Pays the permit fee. <br /> <br />c. Furnishes proof of financial responsibility. <br /> <br />d. Submits an operational plan. <br /> <br />e. Published a Notice of Intent to Modify Weather <br /> <br />All of these were satisfied prior to the time of the hearing as <br />follows: <br /> <br />a. Michael John Eggers has filed for the weather modification <br />license, and meets the statutory requirements. <br /> <br />b. The permit fee of $200.00 ($100 for the license and $100 for <br />the permit). has been paid. <br /> <br />c. Travelers Insurance Company certificate of insurance in the <br />amount of $2,000,000.00, has been filed. <br /> <br />d. The operational plan is outlined in the application. <br /> <br />e. A Notice of Intent in the form and content attached to the <br />application has been published in the newspapers (designated by the <br />
