DECISION AND PERKIT RENEWAL

This matter came up for review and permit renewal by Hamlet J.
. Barry, III, Acting Executive Director, Colorado Department of Natural
Resources.

FINDINGS OF FACT

1. Because the permit application was substantially the same as
for the 1978 program conducted by Western Kansas Groundwater Management
District #1 upon which a hearing had been held, the Director determined
that a hearing was unnecessary pursuant to review and permit renewal.

2. The Findings of Fact were predicated upon the careful review
and consideration of the following:

a. The Application for Permit for Weather Kodification
Activities, Form WK2, dated March 15, 1983.

b. The Applications for Permit Renewal for Weather Modification
Activities, Form WK2, dated March 18, 1982, April 14, 1981.
March 17, 1980, and April 25, 1979.

c. The original Application for Permit for Weather Modification
Activities, Form WK2, dated Harch 16, 1978 for which permit
was issued Kay 8. 1978.

d. Public he~ring on April 18, 1978 at 10:00 a.m. in Lamar,
Colorado.

e. Advice, comments. and recommendations of the Weather
Rodification Advisory Committee tendered to the Office of
Executive Director.

f. Weather Modification Act of 1972, Article 20, Title 36,
C.R.S. 1973.

g. Written materials and articles submitted by the Applicant.

3. The nature of the proposed program is to undertake a Kay I.
1983 - August 31, 1983 commercial (operational) weather modification
program utilizing aerial application of silver iodide nucleating material
to:

a) increase rainfall
b) suppress hail

The target area for such a program is entirely outside and east
of the State of Colorado. The operator antiCipates the necessity of
seeding upwind some fifteen miles within Colorado to impact Greeley
County in Kansas. Funds for said project are from sources outside the
state of Colorado.

4. The Applicant has demonstrated that the persons in control of
the project regarding seeding within Colorado will be strictly limited to
Hr. William J. Carley and Hr. English Hammond who possess valid Colorado
weather modification licenses.
