<br />FINDINGS <br /> <br />1. An application for a Colorado weather modification permit has been properly made <br />by Colorado Southern Farms, Inc., of Center, Colorado, which is the sponsor of the <br />proposed project. <br /> <br />2. <br /> <br />The person proposed to be in charge of the project for the applicant is Michael John <br />Eggers, of Center, Colorado and Nelson, New Zealand, who is qualified by <br />professional experience (6 years observation, study, and design of hail cannons and <br />6 years manufacture, design, installation, and operation of hail cannons) to condu~t <br />weathennodification operation(mthestate. .. .'. . <br /> <br />3. The permit application review fee of $100.00 has been paid by Southern Colorado <br />Farms, Inc., by check No. 4222 dated June 5, 1996. [~36-20-l12(1)(b), CRS] <br /> <br />4. Proof of financial responsibility has been provided by the applicant by means of a <br />Certificate of Insurance dated June 4, 1996, which evidences that the applicant is <br />covered by commercial general liability insurance in the aggregate amount of $2 <br />million through Travelers Insurance Company of Hartford, Connecticut, which is <br />licensed to do business in Colorado. [ ~ 36-20-112(1)(c), CRS] <br /> <br />5. The proposed operational plan for the project submitted by the applicant meets the <br />requirements of ~ 36-20-112(1)(d), CRS. <br /> <br />6. Legal notice of intent to modifY weather was published in a timely manner in the <br />official newspaper of Saguache County, and in the official newspapers of the adjacent <br />counties of Rio Grande, Mineral, Hinsdale, Gunnison, Chaffee, Fremont, Custer, <br />Huerfano, and Alamosa. [~36-20-112(1)(e), CRS] <br /> <br />7. A public hearing on the application was held beginning at 1 :00 p.m. on Monday, June <br />24, 1996, and ending at 4:00 p.m. in the Saguache County Court House at Saguache, <br />Colorado. The hearing was conducted within 20 miles of the target areas and not <br />more than one week following the completion of publication. The hearing was <br />attended by approximately 50 persons. [~36-20-112(2), CRS] A public <br />demonstration of the hail cannon operation was held following the hearing. <br /> <br />8. Because hail cannons are intended to inhibit the formation of hail and/or to modifY the <br />physical condition of hail as it is falling, they are attempts to modify the weather and <br />as such, they are subject to the permitting requirements under the state's Weather <br />Modification Act. <br /> <br />9. The proposed project is ground-based in that it uses equipment located on the ground <br />to generate sound waves. However, the proposed project does not fall under the <br />definition of a "ground based winter cloud seeding" project since is not intended to <br />be operated during the winter nor will it use silver iodide or any other cloud seeding <br />agent. <br /> <br />4 <br />
