<br />RECORD OF DECISION <br />On an Application for <br />WEATHER MODIFICATION PERMIT NO. 95-5 <br /> <br />APPLICANT: <br /> <br />Western Kansas Groundwater Management District No.1 <br />P.O. Box 604 <br />Scott City, Kansas 67871 <br /> <br />DATE OF APPLICATION: March 10, 1995, as amended by letter dated March 28,1995. <br /> <br />PROJECT: <br /> <br />Commercial seeding operation for hail suppression in Kansas using <br />cloud base and cloud top aircraft which may seed with any of the <br />following agents to generate ice nuclei: silver iodide-acetone solution, <br />dry ice, and pyrotechnics. The area over which the applicant will be <br />allowed to conduct seeding operations in Colorado is as described in <br />paragraph 2 of the "Terms and Conditions" of the permit. <br /> <br />PERMIT SOUGHT: <br /> <br />Original permit pursuant to section 36-20-112, C.R.S., with <br />conditional approval for a time period in excess of one year's duration <br />pursuant to section 36-20-114, C.R.S. <br /> <br />ACTION TAKEN: <br /> <br />Permit granted subject to the terms and conditions stated therein. <br /> <br />, <br /> <br />DELEGATION OF AUTHORITY <br /> <br />This application was acted upon by the Director of the Colorado Water Conservation Board <br />pursuant to the delegation of authority to him from the Executive Director of the Colorado <br />Department of Natural Resources since September 25,1987 and reaffirmed October 14, 1992. <br /> <br />MATERIALS REVIEWED <br /> <br />In considering and acting upon the subject application, the following information and <br />materials were taken into account: <br /> <br />a. Application for an original pennit for Weather Modification Activities, Form WM2, <br />dated March 10, 1995, as amended by letters dated March 28, 1995 and May 29, <br />1995 from Mr. Curtis D. Smith, the project's licensed operator. <br /> <br />b. Application for a Colorado weather modification license for Curtis D. Smith dated <br />March 6, 1995. <br />
