<br />DEPARTMENT OF NATURAL RESOURCES <br /> <br />Q.S- <br /> <br />STATE OF COLORADO <br /> <br />IN THE MATTER OF THE APPLICATION OF <br />COLORADO INTERNATIONAL CORPORATION FOR <br />A PERMIT TO CONDUCT WEATHER MODIFICATION <br />OPERATIONS FOR AND ON BEHALF OF WESTERN <br />KANSAS GROUNDWATER MANAGEMENT DISTRICT NO. <br /> <br />) <br />) <br />) <br />) <br />1.) <br /> <br />DECISION AND PERMIT <br /> <br />This matter came on for public hearing on Ap-ri-l 18, -197-8" at <br />10:00 a.m., before Harris D. Sherman, Executive Director, Colorado Department <br />of Natural Resources, at the City Complex, Lamar, Colorado, in Prowers County. <br />The proceedings were recorded by-electronic recording equipment and are <br />available for review or transcription upon request. <br /> <br />The Director was assisted at the hearing by the following members <br />of the Weather Modification Advisory Committee: <br /> <br />Dr. Barbara Farhar <br />Mr. Donald Wisdom <br /> <br />The Committee was assisted by Mr. John LeCompte of the Colorado <br />Water Conservation Board and Mrs. Barbara Welles of the Department of Natural <br />Resources. <br /> <br />Colorado International Corporation was represented by Mr. Ralph <br />Papania and Mr. Keith Lebbin of the Western Kansas Groundwater Management <br />District No. 1. <br /> <br />Testimony was offered by persons in attendance of said hearing in <br />favor of the application. <br /> <br />FINDINGS OF FACT <br /> <br />1. The Findings of Fact were predicated upon the careful review and consideration <br />'.'"of the following: <br /> <br />a. The original Application for Permit for Weather Modification Activities, <br />FoLm WM2, dated 'l1arch 16, 197t, with an attached map, <br /> <br />b. A tape recording of the hearing conducted in <br />April 18, 1978. <br /> <br />Lamar <br /> <br />on <br /> <br />c. Oral conwents from citizens expressing an interest in this Application. <br /> <br />d. Advice, comments and recommendations of the Weather Modificatkon <br />Advisory Committee tendered to the Executive Director on April 18, 1978, <br />as well as comments subsequent to that date. <br /> <br />e. Weather Modification Act of 1972, Article 20, Title 36, C.R.S. 1973. <br /> <br />f. Written materials and articles submitted subsequent to the hearing by <br />the Applicant. <br /> <br />2. The nature of the proposed program is to undertake an April-September <br />commercial (operational) weather modification program through the use of <br />aircraft to: <br /> <br />a. increase rainfall <br /> <br />b. suppress hail <br /> <br />The target area for such a program is entirely outside to the east of the <br />state of Colorado. The operator anticipates the necessity of seeding up- <br />wind some 20 miles within Colorado to impact border counties within the <br />target area inside Kansas. Funds fOL said project are from sources <br />outside the state of Colorado. <br />
