Dear Mr. Lebbin:

This is to notify you that your application for a permit to seed clouds over Colorado in
order to cause an effect in Kansas dated February 12, 1996 has been denied. Please find enclosed
my Record of Decision for your infonnation and files.

The decision to deny your request for a CQlorado weather modification permit was made
after a thorough review of the facts. The infonnation in your application and infonnation
provided at the public hearing in Lamar on April 2, 1996 was carefully compared against the
criteria set forth in the Colorado statutes at Section 36.20-112 (3)(a-h). The application failed to
meet the requirements of three criteria (a,b, and h).

The difference in reviewing your permit this year was a separate examination of the effects
of the program in the operational area in Kansas and in Colorado. The principal reason for the
denial is there are no intended benefits to the people in the operational area in Colorado or to the
people of the State of Colorado.

If the program could be re-fonnulated to include a definite identifiable benefit in Colorado,
we will reconsider your application. I suggest that the first step would be to work with water
user groups in Colorado and our agency to design a program in Colorado.
