<br />~., <br /> <br />\ , <br /> <br />" <br /> <br />RECORD OF DECISION <br />an an <br />APPLICATION FOR A WEATIiER MODIFICATION PERMIT <br /> <br />APPLICANT: <br /> <br />Colorado Greenhouse, Inc, <br />6811 WCR31 <br />Fort Lupton, CO 80621 <br /> <br />DATE OF APPLICATION: <br /> <br />June 12, 1998 <br /> <br />PROJECT: <br /> <br />Commercial operation of hail suppression device (commonly referred to as <br />a "Hail Cannon") using sequenced sound waves to produce a cavitation effect <br />in the ice forming areas of cumulus cloud formations to inhibit the formation <br />of ice particles and cause the moisture to fall as rain rather than hail. <br /> <br />TARGET AREA: <br /> <br />The target areas includes portions of: <br /> <br />Township 2 North, Range 66 West, Section 34; a part of the NorthWest Y. (East of Fort Lupton, Colorado) <br />Township 3 North, Range 56 West, Section 10, a part of the NorthEast Y. (South of Brush, Colorado) <br /> <br />DURATION: <br /> <br />The operation is proposed to begin upon the issuance of the Permit in <br />August, 1998 to be effective for year-round operations and in subsequent <br />years thereafter for such time as the Permit remains valid and in effect. <br /> <br />PERSON IN CHARGE: <br /> <br />The person in charge of the project is Matthew B. Cook, Executive Vice <br />President of Colorado Greenhouse, Inc, <br /> <br />PERMIT SOUGHT: <br /> <br />An original permit pursuantto c.R.S, ~ 36-20-112, <br /> <br />ACTION TO BE TAKEN: <br /> <br />The findings will be the basis for a decision to either grant the permit, grant the permit <br />subject to conditions, or deny the permit. <br /> <br />DELEGATION OF AUTIIORITY <br /> <br />This application was acted upon by the Director of the Colorado Water Conservation Board pursuant to the <br />delegation of authority to him from the Executive Director of Colorado Department of Natural Resources, <br /> <br />MATERIALS REVIEWED <br /> <br />In considering and acting upon the subject application, the following information and materials were taken into <br />account: <br /> <br />I. Application for Weather Modification Permit, Form WM2, dated June 12, 1998, for Colorado <br />Greenhouse, Inc" signed by Anthony V. Mello, Attorney for Colorado Greenhouse, Inc" and including <br />an operation plan and a point by point response to the specific questions in the application (Exhibit I), <br /> <br />2, Map showing the following target areas and list for each, (Attachment A to Form WM2), <br /> <br />3, Copy of a Certificate of Insurance issued by Colorado Farm Bureau Insurance for commercial general <br />liability in a general aggregate amount of $10,000,000 for the period from May 18, 1998 to May 18, <br />1999, (Attachment B to Form WM2), <br /> <br />4, Public Notices of Intent to ModifY Weather and affidavits evidencing the publication of the same once <br />each week for two consecutive weeks during May, 1998 in the official newspapers of the appropriate <br />
