<br />I" <br /> <br />"'. <br />, <br /> <br />November 30, 1977 <br /> <br />~ <br />-~ <br />C\t <br /> <br />AVAILABILITY OF WAT~~ FOR CONTRACT <br />WITH EL PASO NATURAL GAS CO"1P.~!Y <br />PURSUANTl'O SEClIO/: 11 OF THE ACT OF <br />JUNE 13, 1962, AUTHORIZING -THE NAVAJO <br />A.'ID SAN JTJAN-ClW1A PROJECTS, NEH NEZICO <br /> <br />On Novenber 26, 1963, the Commissioner of Reclamation sent a memorandum <br /> <br />to Assistant Secretary of the Interior for Water and Power Development <br /> <br />which was appro'/ed December 5, 1963, That document, copy enclosed, <br /> <br />established the hydrologic basis for implementing the sale of municipal <br /> <br />fu,d industrial (M&I) water from Navajo Reservoir under long-term contracts <br /> <br />as provided in the following part of secticn 11 of the authorizing ;'.ct <br /> <br />of June 13, 1962, for the llavajo and San Juan-Chama Projects (76 Stat. 96): <br /> <br />"No long-tern:. contract, except contracts for the benefit of the <br /> <br />lands a~d for the purposes specified in sections 2 and 8 of this <br /> <br />Act, shall be ente~ed into for the deliv~rJ of water stored in <br /> <br />rTaV9.jo nese!'voir or of any other waters of the San Juan River and <br /> <br />its tributaries, as aforesaid, until the Secretary has determinet <br /> <br />by hydrologic investigations that sufficient water to fulfill said <br /> <br />contract is reasonably likely to be available for use in the Stat~ <br /> <br />of !lev ~'!exico during the term thereof under the allocations made <br /> <br />in articles III and XIV of the Upper Colorado River Basin compact, <br /> <br />and has submitted such determination to the Congress of the <br /> <br />United States and the Congress has approved such contracts. <br /> <br />" <br />
