<br /> <br />Chronology <br /> <br />1849 - California Gold Rush begins, triggering <br />major changes to the state's natural environ- <br />ment, as miners divert streams and rivers to <br />facilitate placer mining and hydraulic mining, <br />1854 - California Supreme Court in Eldridge v, <br />Cowell (4 Cal. 80) lays foundafion for Public <br />Trust doctrine when it recognizes that the state <br />has an obligation to preserve the right of <br />navigation on water bodies. <br />1884 - In People v. Gold Run Ditch and Mining <br />Co, (66 Cal. 138), California Supreme Court <br />expands Public Trust doctrine by upholding an <br />injunction that prevented placer mining along <br />the north fork of the American River because <br />mining had raised the river bed, impaired water <br />quality, and impeded navigation, <br />1902 - Reclamation Act passed by Congress, <br />encouraging flood-control projects on major <br />rivers to provide irrigation water for agricul- <br />ture, flood protection, and hydroelectric power, <br />1933 - California Legislature enacts California <br />Central Valley Project Act, taken over in 1937 <br />by the federal government to become the CVP. <br />1960 - California voters authorize construction <br />of State Water Project. <br />1968 - National Wild and Scenic Rivers Act <br />passed, <br />1969 - California enacts Porter-Cologne Water <br />Quality Act investing State Water Resources <br />Control Board (State Board) with full authority <br />to set water-quality objectives and issue dis- <br />charge permits, <br />1972 - Federal Water Pollution Control Act <br />Amendments (Clean Water Act) enacted, <br />establishing national water quality standards, <br />1973 - Federal Endangered Species Act enacted, <br />1983 - Landmark Mono Lake decision (National <br />Audubon Society v. Superior Court, 33 Cal.3d <br />419) applies Public Trust doctrine to non- <br />navigable tributaries of Mono Lake, holding <br />that Los Angeles Department of Water and <br />Power's (LADWP) right to divert water must <br />be balanced against public trust values of <br />Mono Lake and its tributaries. <br />California Endangered Species Act enacted, <br />1986 - Racanelli Decision (named for California <br />Appellate Court Justice John Racanelli) issued <br />(U.S, v. State Water Resources Control Board, <br />182 Cal.3d 82) holding that water rights should <br />not be considered in setting water quality <br />standards for the Delta, <br />1989 - Fish are declared a public trust resource <br />under Fish & Game Code Section 5937 <br /> <br />(California Trout v, State Water Resources <br />Control Board, 207 Cal.App, 3d 585), <br />1992 - Central Valley Project Improvement Act <br />(CVPIA) enacted providing for greater <br />environmental restoration. <br />1992 - California Appellate Court holds in <br />Department of Fish and Game v. Anderson- <br />Cottonwood Irrigation District (8 Cal.App.4th <br />1554) that prohibitions against taking under <br />the California Endangered Species Act apply <br />not only to activities such as hunting and fish- <br />ing, but also to operation of pump diversions <br />that affect endangered fish, In similar case <br />(U.S, v, Glenn-Colusa Irrigation District, 788 <br />FSupp 1126), a federal court enjoined the <br />irrigation district from pumping water from a <br />facility during the winter-run salmon's peak <br />downstream migration period because pump- <br />ing screens were inadequate to prevent <br />entrainment of large numbers of fish and the <br />district had failed to apply for an incidental take <br />permit. <br />1993 - Federal court for the Eastern District of <br />California holds in Natural Resources Defense <br />Council v. Patterson (791 F Supp, 1503) that <br />the federal CVP must comply with Fish & <br />Game Code Section 5937 requiring release <br />of flows for fishery preservation below all <br />dams; affirmed in 1998 by federal appeals <br />court. <br />1994 - State Board amends water rights licenses <br />of the LADWP, ending the 15-year battle over <br />Mono Lake, LADWP is restricted from diverting <br />water until the lake rises 20 feet. <br />Bay-Delta Accord reached between state and <br />federal agencies, leading to collaborative <br />CALF ED process to develop long-term, <br />consensus solutions to Delta issues. <br />1996 - California voters approve Proposition 204, <br />a $995 million general obligation water bond, <br />The measure provides $600 million for <br />Bay-Delta restoration projects <br />1998 - CALFED releases "programmatic" dralt <br />EIS/EIR offering three alternatives tor "fixing" <br />the Delta, <br />2000 - California voters approve Propositions 12 <br />and 13 to issue about $4 billion in state <br />bonds to fund numerous water and parks <br />improvement projects, including habitat <br />protection, watershed rehabilitation and land <br />acquisition. <br />CALFED releases its action plan for address- <br />ing Delta water issues over 30-year period, <br /> <br />1) <br />
