<br />Other environmental concerns may be addressed in other areas
<br />of the law. California and Washington have laws requiring the
<br />assessment of environmental impacts of major developments, laws
<br />that can be ,applied to water rights. California's Environmental
<br />Quality Act requires the preparation of an environmental impact
<br />report for any proposed major project, including any major water
<br />use application.13 This applies to transfers as well as new
<br />appropriations.

<br />In an area of scarce water and growing population, any
<br />unintentional loss of water that could have been saved and reused
<br />merits examination. Two states, California and Oregon, have laws
<br />encouraging water salvage, generally awarding title of the
<br />salvaged water to the saver.

<br />A thorough scoping study could include a look at these
<br />various provisions in neighboring states, with analysis of what
<br />works and what doesn't.
