An application is filed with the water court. C.R.S. 937-92-302(1)(a). <br /> <br />2. The water court publishes the application in local newspapers and in the <br />monthly "resume" prepared by the water clerk. c.R.S. 9 37-92-302(3). <br /> <br />3. Any person who wishes to oppose the application may file a "statement of <br />opposition" within 60 days. C.R.S. 937-92-302 (b), (c). <br /> <br />4. The case is referred to the water referee, who investigates the case, consults <br />with the division and/or state engineer, C.R.S. 937-92-302(4), and enters a <br />ruling within 60 days after the deadline for filing statements of opposition. <br />C.R.S. 937-92-303(1). <br /> <br />5. If the matter is contested, it will be re-referred to the water judge for de novo <br />hearings and/or trial. c.R.S. 9 37-92-304(3). Proceedings are conducted <br />pursuant to the Colorado Rules of Civil Procedure and the Uniform Water <br />Court Rules. See, especially, C.R.C.P. Rules 87-91. <br /> <br />6. The result of an adjudication is either the denial of the water right or the entry <br />of a decree confirming the water right, establishing a priority, and <br />determining the various parameters of the water right, such as quantity, <br />source, point of diversion, type of use, place of use, etc. <br /> <br />7. Appeals of water court decisions go directly to the Colorado Supreme Court. <br />Colo. Const., Art. VI, 9 2(2); C.R.S. 9 13-4-102(1)(d); CAR. l(a)(2). <br /> <br />3 <br />
