RESOURCES & ENEIlGT <br />BY SENATORS Glass, Lee, Fenlon, and Peterson; <br />also REPRESENTATIVES Herzog, Hume, and Underwood. <br /> <br />A BILL FOR AN ACT <br />1 CONCERNING WATER RIGHTS FOR CONSERVED AGRICULTURAL WATER, <br /> <br />Bill Summary <br /> <br />(Note: This summary applies to this bill as introduced <br />and ~ not necessarily reflect ~ amendments whiCh may be <br />subsequently adopted,) <br /> <br />Provides that, when the owner of an absolute agricultural <br />water right uses conservation methods to reduce the historic <br />consumptive use of the water right, he may use, sell, lease, <br />exchange"or make available for augmentation or substitute <br />supply the amount of water which he conserves, Further <br />provides, however, that no injury can occur to the owners of <br />water rights or persons entitled to use water under a water <br />right, Requires that a change of water right decree must be <br />obtained before the use -of the conserved water is changed, <br />Provides that conserved water does not include water which was <br />wasted historically, Calculates the measure of conserved <br />water as the difference between the historic consumptive use <br />and the reduced consumptive use of the agricultural water <br />right, Contains a savings proviso which recognizes that <br />articles of incorporation, bylaws, or contractual arrangements <br />of a ditch or reservoir company may prevent transfer or change <br />of water out of the ditch or reservoir, <br /> <br />2 ~ it enacted ~ ~ General Assembly of the State of Colorado: <br /> <br />3 <br /> <br />SECTION 1, Article 82 of title 37, Colorado Revised <br /> <br />4 Statutes, as amended, is amended BY THE ADDITION OF A NEW <br /> <br />5 SECTION to read: <br />
