<br /> <br />The Water Quality Control Commission is involved in a systematic stream <br /> <br /> <br />classification program which has a further impact on waste water returning to the <br /> <br /> <br />classified stream segment, <br /> <br /> <br />The Colorado Mined Land Reclamation Board reviews the sufficiency of <br /> <br /> <br />water rights in the course of the permit approval process. Besides detailing the <br /> <br /> <br />effects of the proposed operation on surface and groundwater, the operator is <br /> <br /> <br />required to estimate project water requirements and to indicate the water rights and <br /> <br /> <br />sources of water to supply those requirements. <br /> <br /> <br />The Colorado Water Consenation Board was created in 1937 with the power <br /> <br /> <br />to: (I) foster, encourage, and assist in the financing of various types of districts, <br /> <br /> <br />mutual companies, and other agencies created under federal and state laws; (2) <br /> <br /> <br />cooperate with the federal government and others in formulating plans and gather- <br /> <br /> <br />ing information about water plans and projects; (3) submit drafts of proposed federal <br /> <br /> <br />and state legislation; (4) investigate plans and activities of the federal government and <br /> <br /> <br />other states which might affect interstate waters of Colorado; (5) confer and appear <br /> <br /> <br />before appropriate agencies and the court to protect Colorado's interests in interstate <br /> <br /> <br />waters in Colorado; (6) acquire real property for flood prevention or flood control <br /> <br /> <br />with respect to federally authorized projects, (7) promote water conservation in the <br /> <br /> <br />state in order to secure the greatest utilization of such water; and (8) contract for <br /> <br /> <br />the construction of conservation projects inside and outside the state and perfect <br /> <br /> <br />water rights in the name of the Department of Natural Resources, <br /> <br /> <br />The board continuously studies the water resources of the state, including <br /> <br /> <br />present and potential uses, and has authority to conduct state water planning under <br /> <br /> <br />the Federal Water Resources Planning Act. The board also has the power to file <br /> <br /> <br />claims for minimum stream flows to protect the environment to a reasonable degree. <br /> <br /> <br />The board has pursued such filings aggressively in many drainages. <br /> <br /> <br />7. Method of Acauirin2 Ri2hts <br /> <br /> <br />The Colorado constitution declares that the right to divert and put <br /> <br /> <br />unappropriated water to beneficial use .shall never be denied."
