The request by an appropriator for water which the person is entitled to under <br />his decree, Such a call will force those users with junior decrees to cease or <br />diminish their diversions and pass the requested amount of water to the <br />downstream senior making the call. <br /> <br />Colorado Doctrine The doctrine regulating water usage by priority of appropriation <br />as opposed to riparian rights, See Aoorooriation Doctrine, <br /> <br />Comoact An agreement between states apportioning the waters of a river basin to <br />each of the signatory states as approved by Congress, <br /> <br />Conditional Water Right An unperfected water right coupled with right to perfect <br />it with reasonable diligence. <br /> <br />Decree An official document issued by the court defining the priority, amount, use, <br />and location of the water right. <br /> <br />Deoletion Use of water in a manner that makes it no longer available to other users <br />in the same system, <br /> <br />Designated Groundwater Groundwater which, in its natural course, would not be <br />available to and required for the fulfillment of decreed surface rights, in areas <br />not adjacent to a continuously flowing natural stream wherein groundwater <br />withdrawals have constituted the principal water usage for at least fifteen <br />years preceding the date of the first hearing on the proposed designation of <br />the basin, and which is within the geographic boundaries of a designated <br />groundwater basin, <br /> <br />Designated Groundwater Basin An area established by the Groundwater Commission. <br />Once a groundwater basin is designated, an appropriation thereof can only <br />be made by application to the commission, <br /> <br />Develooed Water Water that is produced or brought into a water system through the <br />efforts of mankind, where it would not have entered the water system on its <br />own accord, <br /> <br />Diligence Action taken towards the perfection of a conditional water right. In <br />Colorado, when a conditional right is granted by the court, the applicant must <br />demonstrate in a quadrennial proceeding steps that have been taken toward <br />perfecting that right. If diligence in perfecting an appropriation is not <br />demonstrated, the right is lost. <br /> <br />Diversion Removing water from its natural course or location, or controlling water <br />in its natural course or location, by means of a ditch, canal, flume, reservoir, <br />bypass, pipeline, conduit, well, pump, or other structure or device, <br /> <br />Division Engineer The person charged by delegation from the state engineer, <br />Division of Water Resources, Colorado Department of Natural Resources, with <br />the duty of administering water flows and diversions within a specific water <br />basin, Their offices are located in the cities where water courts are located, <br /> <br />Effluent Discharge Disposal of water previously used for municipal and household <br />purposes: sewage discharge. <br /> <br />Futile Call Arises when the cessation of diversions by a junior appropriator would <br />not result in a significant increase in water available to a downstream senior <br />appropriator, In such cases the call need not be honored. <br /> <br />2 <br />
