Exchange permits water to be used upstream, so long as the same quantity of <br />water is provided at a point downstream which will avoid injury to other water <br />users. <br /> <br />3. Rights of exchange can be decreed and thereby secure a fixed priority for their <br />operation. <br /> <br />FARM AND RANCH PROPERTIES: EVALUATING WATER RIGHTS <br /> <br />A, <br /> <br />Identification of Water Rights <br /> <br />1. Evaluation begins with identification of all water rights which are pertinent to <br />the property . <br /> <br />2. The property owner should have some evidence of ownership of the pertinent <br />water rights: <br />· Deed <br />· Decree <br />· Well permit <br />· Stock certificate <br />· Water allotment contract <br /> <br />3, Visual inspection of the property may disclose uses and related rights. <br /> <br />Analysis of Water Rights <br /> <br />1. The current use of water should be compared with the legally authorized use. <br />For example: <br />· Is the point of diversion located as decreed? <br />· Is water being used for its decreed purposes? <br />· Is the water belli applied to the decreed acreage? <br /> <br />2. The historical use of the water should be determined, particularly if the water <br />rights will be changed to new points of diversion or new uses, <br />· The right to change a water right is limited to the time and quantity of <br />the historic use, no matter if the decreed lI.tI1olU1t is greater. <br /> <br />3, Investigate possible non-use of the water right for abandonro.ent purposes. <br />· Check Division Engineer abandonment lists. <br /> <br />. -8- <br />
