Fetcher <br /> <br />-3- <br /> <br />December 29, 1982 <br /> <br />Upper Yampa District, after it has contracted for the <br />sale of an additional 9,000 acre feet per annum, will <br />thereafter until such time as otherwise notified by <br />Colorado-Ute, use its best efforts to resell such water <br />to other users, and to credit Colorado-Ute for the <br />amounts of such re-sale. <br /> <br />It is understood by the Parties that if these concepts are <br />generally agreeable, the Parties will proceed to prepare and <br />execute contracts setting forth in detail the rights and <br />Obligations of each party. This letter is subject to the approval <br />of the Boards of the Directors of the respective parties.
