District 65 rules allow the funds to <br />be used "for other purposes that the Committee deems to be of benefit to Water District <br />65."" The difference between these two provisions seems to be whether the board of <br />the local water district, or the local rental pool committee, has authority over the use of <br />bank proceeds. State law provisions were amended in 1992 to clarify the authority of the <br />water district advisory committee, when appointed by the Board to serve as a local rental <br />committee, over the use of rental pool proceeds retained by the district." The use of <br />such proceeds must be consistent with the public purposes descnbed above and with <br />resolutions adopted by the water users of the district. Rental pool funds in District 1 <br />have been used in part to pay attorney fees.'" <br /> <br />2.1.2.9 Lease terms and carry over <br />Lease and rental terms for bank transactions are not dictated by state law, and <br />vary among local committees. For the water supply bank, the term during which a water <br />right can be retained in the water bank is open to specification in the purchase or lease <br />agreement. Rentals from the bank can be approved by the Director for a period of up <br />to five years. Applications for longer periods require Board approval. <br />In District 1, leases of reservoir space to the rental pool may be made for periods <br />up to 20 years and are to be negotiated on a case-by-case basis.'1 In Districts 63 and 65, <br />bank rentals are limited to a term of one year. The District 1 rental pool, like Districts <br />63 and 65, require that rented water be used during the current water district year which <br />ends on March 1 of the following year.
