The collection of data and the payment of <br />expenses therefor, including salaries of engineers and attor- <br />neys and other clerical assistants, to conserve the water of <br />said district and to enable said district to adopt plans and <br />projects for the orderly development of said district is <br />hereby declared to be a matter of general benefit to the <br />pUblic welfare, and such that taxes for said purposes may be <br />properly imposed, in the opinion of the general assembly. <br /> <br />(e) If this subsection (1) or any clause, phrase or part <br />thereof be held unconstitutional or invalid by any court of <br />competent jurisdiction, suCh decision shall not affect the <br />validity or force of any other part of this section nor any <br />other part of this law and the general assembly hereby de- <br />clares it would have enacted the remainder of this article <br />without said sUbsection (1) of this section. (1958). <br /> <br />(2) The board of said district may in lieu of the level <br />or general tax authorized by subsection (1) of this section, <br />levy special assessments upon all real estate within the dis- <br />trict, except such real estate as is hereinafter exempted. to <br />raise funds to pay expenses of organization, salaries, expenses <br />and per diem allowances of officers and directors and to pre- <br />pare a general plan for the maintenance of constant stream <br />flow and adequate water supplies in all the principal tribu- <br />taries and the main stream of the Colorado river in said dis- <br />trict, and provide for future development of the dist.rict and <br />insure water therefor. Such assessments shall be made in pro- <br />portion to the benefits to each piece of real estate accruing <br />by reason of the adoption of a comprehensive plan of develop- <br />ment of the natural resources of the district as a Whole. <br />The board of directors if it deems it advisable at any time <br />before levying special assessments shall appraise the bene- <br />fits to the several parcels of real estate within the district. <br />which shall result from the organization of said district and <br />the general plans and development aforesaid. The board may <br />adopt rules for such purpose and provide inter alia for <br />notice and hearing to all persons affected thereby. A perma- <br />nent record arranged by counties of the benefits which will <br />accrue to each tract of land shall be kept and such benefits <br />shall be apportioned over a series of years, the amount. t.o be <br />collected each year to be in the discretion of the boardl pro- <br />vided the amount of such assessment to be levied and assessed <br />against the real property in said district anyone year shall <br />not exceed a total of seventy-five hundred dollars and it. is <br />hereby declared that the amount of special benefits accruing <br />annually to the real estate in said district is in excess of <br />
