<br /> <br />first physical step in furtherance of the plan to <br />appropriate is entitled to relate his priority date to <br />the time the project was begun if the appropriation is <br />completed with due diligence. <br /> <br />Under the 1969 Act, the holder of a conditional water <br />right must show to the court each four years that he is <br />proceeding with reasonable diligence to perfect his <br />water right. Failure to proceed with reasonable <br />diligence may result in cancellation of the conditional <br />water right by the water court. <br /> <br />Nature of Right Acquired <br /> <br />A water right is a property right under Colorado law. <br />As an inherent part of this property right, Colorado <br />law recognizes the right of an owner to change the <br />place of use, point of diversion, time or type of use of <br />a water right, provided that such changes do not <br />injure the vested water rights of others. <br /> <br />Both junior and senior appropriators have a right to <br />resist all proposed changes in water rights which would <br />materially injure their rights. . <br /> <br />If a proposed change would cause InJury, and <br />conditions may be imposed on the change which would <br />prevent such injury, the change will be permitted <br />subject to such conditions. <br /> <br />Loss of the Right <br /> <br />A water right may be lost by abandonment or adverse <br />possession. A conditional water right may be lost by <br />abandonment or failure to exercise due diligence in <br />putting the water to a beneficial use. . <br /> <br />36 <br />
