Because of their complexity and the issues involved, the <br />two cases (86-CW-226 and 88-CW-178) were re-referred to the Water <br />Judge by the Referee pursuant to S37-92-303(2), C.R.S. 15. Thus, <br />no Ruling was issued by the Referee, and the issues on water avail- <br />ability in said cases were eventually consolidated for the trial. <br />. <br /> <br />5. As an overview, the conditional water rights sought in <br />these cases comprise a large water development known as the Union <br />Park Project. The Project-seeks the trans-mountain diversion of <br />water by which water is taken from the Upper Gunnison River Basin <br />located west of the Continental Divide in Gunnison County, thence <br />moved through a tunnel to the Antero Reservoir located on Colo- <br />rado I s Eastern Slope in Park County, and thence piped to the County <br />of Arapahoe for ultimate use by its inhabitants. The Project <br />anticipates diverting water from the East River and the Taylor <br />River (and certain of their respective tributaries) which two <br />rivers join at the Town of Almont in Gunnison County, Colorado, to <br />form the Gunnison River. <br /> <br />6. ~ APPLICATION IN '86-CW-226: The original application was <br />filed in 86-CW-226 by Natural Energy Resources Company (NECO) <br />making claim for conditional water rights for the Union Park <br />Project. Said Project contemplated two principal structures: <br /> <br />a. The primary structure was Union Park Reservoir which <br />would be constructed on Lottis Creek, a tributary to the <br />Taylor River, with a capacity of 900,000 acre feet. In a <br />prior case, 82-CW-340 in this court, the Union Park Reservoir <br />had already obtained a conditional decree for the storage of <br />325,000 acre feet to be used as part of the Union Park hydro- <br />electric project. The 900,000 acre feet capacity contemplated <br />by the application in 86-CW-226 included the 325,000 acre feet <br />capacity in 82-CW-340, less 4,450 acre feet which had been <br />transferred to another point of storage in case 85-CW-96. <br /> <br />b. The sources of supply for Union Park Reservoir included: <br />1) Lottis Creek, the creek upon which the reservoir was <br />to be constructed; <br />2) Taylor Park Pumping Plant which would divert water <br />from the Taylor River at Taylor Park Reservoir and <br />pump it to Union Park Reservoir (for which a 1,000 <br />c.f.s. conditional decree was requested); and <br />3) The Willow Creek Collection System and Bertha Gulch <br />Tunnel which is a series of open channels and a <br />tunnel carrying water from Bertha Gulch, three <br />unnamed tributaries of Cow Creek and Willow Creek to <br />Union Park Reservoir (for which 340 c. f. s. was <br />claimed) . <br /> <br />3 <br />
