<br />(b) The director may order any person who is found to be <br />2 conducting a weather modification operation without a 1iceAse <br />3 ~ permit to cease and desist from said operation. Any person <br />4 who fails to obey said order commits a class 6 felony and shall <br />5 be punished as provided in section 18-1-105, C.R.S. <br />6 SECTION 18. 36-20-124, Colorado Revised Statutes, 1990 <br />7 Rep1. Vol., is amended to read: <br />8 36-20-124. Permit as defense in actions. The fact that <br />g a persQn he1~s a nceAse 9r was issu~d a. permit under this <br />10 article, or that lie THE PERSON has complied with the <br />11 requi rements estab1 i shed by the di rector pursuant to thi s <br />12 article, is not admissible as a defense in actions for damages <br />13 or injunctive relief brought against R+m THE PERSON. <br />14 SECTION 19. 36-20-126 (I) (a) and (2), Colorado Revised <br />15 Statutes, 1990 Rep1. Vol., is amended to read: <br />16 36-20-126. Penalties. (l) (a) Any person responsible for <br />17 conducting a weather modification operation without first having <br />18 procured the required 1iceRse aRd permit and any person who <br />19 contracts with or pays another person known to be HRl iceRse~ aRd <br />20 without a permit to conduct a weather modification .operation <br />21 commits a class 6 felony and shall be punished as provided in <br />22 section 18-1-105, C.R.S. <br />23 (2) Any person who makes a false statement in the <br />24 application for a 1iceRse eF permit, &F who fails to file any <br />25 report as required by this article, or who violates any other <br />26 provisions of this article, except as otherwise provided in <br /> <br />-17- <br />
