<br />article. <br /> <br />2 <br /> <br />SECTION 10. 36-20-114, Colorado Revised Statutes, 1990 <br /> <br />3 Repl. Vol., as amended, is amended to read: <br /> <br />4 <br /> <br />36-20-114. Limits of permit. (I) Except for ground-based <br /> <br />5 winter cloud seeding, a separate permit is required annually for- <br />6 each operation. If an operation is to be conducted under <br />7 contract, a permit is required for each separate contract. <br />8 Subject to the provisions of subsection (2) of this section, a <br /> <br />9 permit may be granted for more than one year's duration. A <br /> <br />10 <br /> <br />permit for ground-based-winter cloud seeding shall-be fssuedfor <br /> <br />11 <br />12 <br />13 <br /> <br />a period of five years. IF A PERMIT FOR A GROUND-BASED WINTER <br />CLOUD SEEDING OPERATIDN IS RENEWED, THE SECOND PERMIT SHALL HAVE <br />A DURATIDN DF FIVE YEARS AND ANY THIRD OR SUBSEQUENT PER.~IT <br />SHALL HAVE A DURATION OF TEN YEARS. <br /> <br />14 <br /> <br />15 (2) The director may conditionally approve a project <br />16 other than ground-based winter cloud seeding for a continuous <br />17 time period in excess of one year's duration. Permits for such <br />18 operations must be renewed annually. In approving the renewal <br />Ig of a permit for a continuous program, the director may waive the <br />20 procedures for inltial issuance of a permit in section 36-2D-1I2 <br />21 and, upon review and approval of .the project's operational <br />22 record, the director may issue a renewed permit for the <br />23 operation to continue. In such instances, the fees based "pan <br />24 tee '..al"e af tee cantract IMPOSED pursuant to section 36-20-113 <br /> <br />25 may be prorated and paid on an annual basis. <br />26 (3) A project permit may be granted by the director <br /> <br />-11- <br /> <br />1 <br />i <br />I <br />~ <br />
