The contractor wilt take such action with respect to any sub-contracting or purchase order as Ihe contracting agency may direct. as a means of enforcing such provisions. including sanctions for non-compliance: provided. however. that in the event the contractor becomes involved in. or is threatened with. liligalion with the subconlractor or vendor as a result of such direction by the contracting agency. the contnlCtor may requesl the Slate of Colorado to enter inm such litigation [0 protect !he interesl of the State of Colorado. CRS for preference of Colorado labor are applicable to this comract if public works within the State arc undenaken hereunder and are financed in whole or in pan by Stale funds. b. Nothing contained in any provision incorporated herein by reference which purpons to negate mis or any other special provision in whole or in pan shalt be valid or enforceable or available in any action at law whether by way of complaint. defense or otherwise.
