Colorado. 81623, hereinafter referred to as the Contractor. \VHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance there of remains available for p~ment in Agency PDA. Fund Number 462, Organization 92YY, Appropriation Code 100, Program WTRC, Object Code 5110, Contract Encumbrance Number\.:.. i~~bIO ; and 0> 1\ WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS, the State desires to assist public agencies, established under Colorado law, for the purpose of a pilot program demonstrating the benefits of water efficiency measures by providing incentive grants pursuant to the authority granted in Section 37-60-125, CRS; and WHEREAS, the Contractor's application for a grant from the Water Conservation Board Construction Fund has been received and approved by the Colorado Waler Conservation Board; and WHEREAS, the Colorado Water Conservation Board desires to distribute said funds pursuant to law; and WHEREAS, the Contractor is an eligible public agency to receive grllnt assistance from the Pilot Program for demonstrating the benefits of water d'ficiencymeasures. NOW THEREFORE it is hereby agreed that: I. Area Covered. The Contractor shall perform and accomplish all the necessary work and services provided under this Contract, as described in the allached Exhibit A, which is incorporated herein and made part of this Contract by reference. 2. Scope of Services. In consideration for the monies to be received from the State, the Contractor shall do, perform, and carry out, in a satisfactory and proper manner, as determined by the State, all work elements as indicated in the "Scope of Services", set forth in the attached Exhibit A, hereinafter referred 10 as the "Project" and incorporated herein. Work performed prior to the execution of this Contract shall not be considered part of this Project. 3. Responsible Administrator. The performance of the services r.:quircd hereunder shall be under the direct supervision of Davis Farrar, lln employee or agent of Contractor, who is hereby designated as the administrator-in~charge of this Project. If At any time the administrator-in-charge cha.nges the Board must b~ given wrillen notic~ of the change and must approve the replac~l11enl bdore any further monies arc dislributed. 4. Time of Performance. This Contract shall become effective upon proper execution of lhis Contract by the State Controller or his designee. The Project contemplaled herein shall commence as soon as practicable after the execution of this Contract and shall be undertaken and performed in the sequence set forth in the "Time of Performance" in the attached Exhibit A. Expenses incurred by the Contractor in association with said Project prior to execution of this Contract shall not be eligible expenditures. The Contractor agrees that time is of the essence in the performance of its obligations under this Contract, and that completion of the Project shall occur no later than the termination date set forth in the Time of Performance in Exhibit A. 5. Comoensationand Method of Payment. The State agrees to pay to the Contractor, in consideration for the work and services to be performed, a total amount not to exceed FIFTEEN THOUSAND. TWO HUNDRED THIRTY FIVE AND NOIlOO Dollars ( $15.235.00 ). The method and time of payment shall be made in accordance with the "Payment Schedule" set forth in Exhibit A. Page I of 6 pages
