WHEREAS, authority exists in the Law and Funds have been budgeted. appropriated and O{herwise made available and a sufficient unencumbered balance there of remaios available for payment in Agency PDA, Fuod Number 424. Organization 92YY, Appropriatioll Code 100, Program WfRC, Object Code 5110, Sub Object Code 20, Contract Encumbrance Number (! /5 3&'5 ; and WHEREAS. required approval. clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS, the State desires to assist public agencies, established under Colorado law, for the purpose of a pilot program demonstrating me benefits of water efficiency measures by providing incentive grants pursuant to the authority granted in Section 37-60-125, CRS; and WHEREAS, the ContraClor's application f{)f a grant from the Water Conservation Board Construction Fund has been recei.ved and approved by the Colorado Watel" Conservation Board; and WHEREAS, Ihe Colorado Water Conservation Board desires to distribute said funds pursuant to law; and WHEREAS. Ihe Conlracror is an eligible public agency to receive grant assistance from Ihe Pilol Program for demonstrating the benefits of water efficiency measures. NOW THEREFORE it is hereby agreed that: 1, Area Covered, The Contractor shall perform and accomplish all the necessary work and services jXovided under this Contract, as described in lhe attached Exhibit A. whim is incorporated herein and made part of lhis Contract by reference, 2, Scope of Services In consideration for the monies (0 be received from the State, the Contractor shan do, perform. and carry out, in a satisfactory and proper manner, as detennined by the State, all work elements as indicated in the "Scope of Services", set forth in the attacbed Exhibit A. hereinafter referred to as the "Project" and incDflXlrated herein. Work performed prior to the exerution of this Contract shall nol be considered part of lhis Project. 3. Responsible Administra~or. The performance of the services required. hereunder shall be under me direct supervision of April Montl!.omcr'{ , an employee or agent of Contractor, who is hereby designated as the administrator-in-charge of this Project. If At any time the administrator-in-charge changes the Board must be given written notice of the change and must approve the replacement before any further monies are distributed, 4. Time of Perfonnance, lhis Contract shall become effective upon proper execution of this Contract by the State Controller or his designee, The Project contemplated herein shall commence as soon as practicable after the execution of this Conlract and shall be undertaken and performed in lhe sequence set forth in the "Time of Performance" in the atlached Exhibit A. Expenses incWTed by the Contractor in association with said Project prior to execution of thjs Contract shall not be eligible expenditures. The Contractor agrees that time is of the essence in the performance of its obligations under this Contract, and that completion of the Project shall occur no later than the termination date set forth in the Time of Perfonnance in Exhibit A. 5. Compensation and Method of Payment. The State agrees to pay to the Contractor, in consideration for the work and services (0 be performed, a total amount not to exceed EIGHT THOUSAND AND NO/IOO Dollars ( $8,000). The method and time of payment shall be made in accordance with the "Payment Schedule" set forth in Exhibil A. Page I of 6 pages
