6. The amount of water:

95 acre feet

7. The use of the water:

This appropriation is made pursuant to C.R.S. 1973,
37-92-102(3) and 37-92-103(3;, and (4). The purpose
of this appropriation by the State of Colorado is to
insure the preservation of a minimum lake level to
protect the natural environmemt to a reasonable degree.

8. The Applicant, by Stipulation, does not ackn"owledge at this
time any rights to water by the United States of America, but in the
future if the Uni ted States of America shall seek appropriate judicial
determination of any cli'limed water right:s in the watershed involved
herein, the Applicant stipulates and agrees that its right shall be
sUbject to any adjudicated senior right of the United S'tates of America.

9. The priority herein awarded said Lower Coney Lake wa~ filed
in the Water Court in the year of 1976 a.nd shall be administered as
having been filed in that year; and shall be junior to all priorities
filed in previous years. As between all rights, filed in the same
calendar year, priorities shall be determined by historical dates of
appropriation and not affected by the date of entry of rUling.
