<br />Tllis appropriation is made pursuant to C.R.S. 1973,
<br />37-92-102(3) and 37-92-103(3) and (4), The purpose of
<br />this aprnopriation by the State of Colorado is 1=0 insure
<br />t-he preservation of a minimum lake level to protect the
<br />natural environment to a rea:3onable degree.
<br />
<br />8. 'l'l1e l\pplicant, by Stipulation, does not acknowledge at this
<br />time any right.s to water by the United States of America, but in the
<br />future if tIle United States of America shall seek appropriate judicial
<br />determination of any cl<limec1 water rights in .the watershed involved
<br />herein, t.hc Applicant stipulates and agrees that its right shall be
<br />subjecL t:o any adjudicated senior right of the United States of America.

<br />9. The priority herein awarded said Mitchell Lake was filed in
<br />the il/a.ter Court in the year of 1976 and shall be administered as having
<br />. been filed in that year; and shall be junior to all priori ties filed in
<br />previous years. As between all rights, fil,~d in the same calendar
<br />year, priorities sh~11 be determined by historical dates of appro-
<br />priation and not affected by the date of entry of rUling.
