<br />This appropriation is made pursuant to C.R.S. 1973,
<br />37-92-102(3) anO 37-92-103(3) ano (4). The purpose of
<br />this appropriation by the S-'.:.at.e of Colorado is to
<br />insure the preservation of a minimum lake level to
<br />protect the natural environment to a reasonable degree.
<br />
<br />8. The Applicant, by Stipulation, does not acknowledge at this
<br />time any rights to water by the United St.ates of America, but in the
<br />future if the United States of America shall seek appropriate judicial
<br />determination of any claimed water rights in the watershed involved
<br />herein, the Applicant stipulates and aqrees that its right shall be
<br />subject to any adjudicated senior right of the United States of America.
<br />
<br />9. The priority herein awarded said Lower Michigan Lake wa-s filed
<br />in the Water Court in the year of 1977 and shall be administered as
<br />having been filed in that year; and shall _be junior to all priorities
<br />filed in previous years. As between all rights, filed in the same
<br />calendar year, priorities shall be determined by historical dates of
<br />appropriation and not affected by the date of entry of rUling.
