On March l7, 1980, hy action of the Colorado Water Conservaticn
Board under the provisions of C,R.S. 1973, 37-92-~02(31,
37-92-103 (3), (4) and (10).

10. This approp~iation is made under the provisions of
C.R.S, 1973, 37-92-102(31 and 37-92-103(31, (4) and (10), knc,wn
as Senate Bill 97, signed in,to law April 23, 1n3.

The Referee does therefore conclude that the above entitled

application should be 9~~nted and that 0.12 acre foot of water,

having a lake sUJ::;"fac.e le.vel of 11,Q97 fe-e.t is h~~reby a\l.'arded 'to

Mexican Cut Nat.ural Pond No.9, for the purpose of maintaining a

minimum lake level as requires to preserve the natural environment

to a reasonahle degreQ, with appropriation d~te of Mnrch 17, 1980,

absolutely ano uncqnditionally; subject, however, to all earlier

priority rights of others and to the intc?ratiQn and tabulation

by the Division Engineer of such pri0rities and changes of rights

in accordancp. with law.

It is accordingly ORDERED that this r1lling shall be filed

with the Welter Clerk and shall become effective upon such filing,

subjec~ to Judicial review pursuanT to S~ction 37-92-304 eRS 1973.

lt is further ORDERED that a copy of this ruling shall be

filed with th@ appropriate nivision Engineer and the State

Engineer.
