COMES NOW.the United States of America, by its attorneys,

and the Applicant, by and through David W. Robbins, Esq.,
and hereby stipulate and agree as follows:

1. The inclusion of the following provisions in the

Referee's ruling and decree of Court entered thereon will

protect the interests of the United States of America, concern

for which prompted the filing of the Statement of Opposition

herein:

(a) Applicant's rights are subject to all senior

rights of the United States of America in

the subject source, including reserved rights,
as are now ~r will hereafter be determined

by law.
(b) Within one year from the date on which the

decree herein becomes final, Applicant agrees

to apply for any special use permits or rights-

of-way, as the case may bet if the same are

required by law for the use of public resources

contemplated by the subject application and

shall abide' by the conditions set forth therein.
