RULING OF REFEREE

The ~bove entitled application was filed.on June 8,

1976, and was referred to the unders.:.gned as "vater Referee
for Water. Division No. 5, State of Colorado, by the Hater
Judge of said Court on the 25th day of June, 1976, in
accordance with Article 92 of Chap.ter 37, Colorado Revised

Administration Act of 1969.

Statutes 1973, known as ~rhe Water Hight Determination and

And the.. undersigned Referee having made such investi-

gations as are necessary to determine whether or not the

statements in the application are true and having become

fully advised \vith respect to the subject matter of the

application does hereby make the following determination and

ruling as the Referee in this matter, to-wit:

1. The statements in the application are true.

2. The name of the structure involved is Deadman Lake.

3. The name and address of the claimant: is The
COlorado Water Conservation Board, 823 State Centennial
Building, 1313 Sherman Street, Denver, Colorado.

4. The source of the water is the -South Fork of
the Frying Pan River, tributary to the Frying Pan River.

5. The lake is located at 39011'~0" north latitude
and 106034'5011 west longitUde. This is in an unSl.lrveyed
township. Sectional projections indicate that the lake is
located in section 8, T. 10 S., R. 82 W. of the 6th P.M.

If a conflict exists bet\veen the descriptio:J. by latitude
and longitude and the sec.t.ional description, the description
by latitude and longitude.will take precedence.
