The above entitled application W{tS :filed on November 1, 1976, and was

referred to the undersigned as Water Referee for Water Division No.5, state

of Colorado, by the Water Judge of sajd Court on the lOth day of December,

1976, and again, after stipulation and ar;reemcnt, on September 12, 1977, in

accordance with Article 9:Z of Chapter 37, Colorado Revised Statutes 1973,

known as The Water Rights Determination and ^dministration Act of 1969.

And the undersigned JZ(~feree having made such investigations as are ne-

cessary to determine whether or not the statements in the application are

true and having become fUlly advised with respect to the subject matter of

the application does hereby make the following determina tion and ruling as

the Referee in this matter, to-wit:

1. The statements in the application ore true.

2. 'fhe name of the structure is Blue Iake.

4. The source of 1:he water is Dowen GUlch, tributary to the Colorado

River.

If iJ conflict exists between the description by latitude and longitude
and the sectional dcscripl:ion, the description by latitude and longitude
will take precedence.

6. The use of the water is to maintain the minimum lake level as re-
quired to preserve the natural environmenl~ to a reasonable degree.

7. 'fhe date of initiation of appronriation is March 17, 1976.

8. The total capacity of the lake is 16 <3cre feet..

9.. The water was first applied to the above beneficial use on r1arch
17, 1976, by action of 1:he Colorado \I(;:>,tet' Conservation Board under the
provisions of C.R.S. 1973, 37-92-102(31, 37-92-103(31, (11 and (101.

10. This ilpproprir.:tion is made unner the provisions of C.R.S. 1973,
37-92-102(31 and 37-92-103(31, (41 and (IO), known as Senate Bill 97, signed
into lilw April 23, 1973.
