RULING OF REFEREE

The above entitled. appliGati.on was filed on June 8,

1976, and was referred to the undersigned as Water Referee

for Wf'.-ter Division No.5, Sta1:e of Colorado, by the Water

Judge of said Court on the 25t:h day of June, 1976, in

accordance with Article 92 of Chap,ter 37, Colorado Revised

Statutes 1973, known as The ,"'vater Right Determination and

Administration Act of 1969.

gations as are necessary to determine whether or not the

statements in the application are true and having beco~e

fully advised with respect to the subject matter of the

application does hereby make the following determination and

rUling as the Referee in this matter, to-wit:

1. The statements in the application are true.

2. The name of the structure involved is Seller Lake.

3. The name and address of the claimant is The
Colorado l-vater Conservat.ion Boardj" 823 State Centennial
Building, 1313 Sherman Street, Denver, Colorado.

4. The source of the water is an unnamed tributary
of Cunningham Creek, tributary to the North. Fork of the
Frying Pan River.

5. The lake is loca.::.cd at 39019'25" north latitude
and 1060351001' west longitude. This is in an unsurveyed
township. Sectional projections i.ndi.cate that the lake is
l-ocatcd in Section 29, T. 8 S., R, 82 N. of the 6th P .M,

If a cO::1flict exists between the description by latitude
and longitude and the sectional de:scription, the description
by latitude and longitude will take precedence.

6. ~he use of the water is to maintain the minimum
