On September 9, 1977, the .following Stipulation was :filed by <br />the Applicant and the Opposer: <br /> <br />COME NOW the United S-t:ates of ^merlca, by its attorneys, ;:lnd the <br />Applicant, Colorado WClter Conservation Board, by and through its attorneys, <br />and hereby stipulate ond uqJ:'E~e as follows: <br /> <br />1. The incl.usion of the following provi.sions in the Referee's rulinq <br />and decree of Court entered thereon will protect: the interests of the United <br />States of America: <br /> <br />(a) Applicant's rights are subject: to all senior rights of the <br />United States of America in \:he subject source, includinq <br />properly decreed reserved r.iqhLs, as are now or will here- <br />after be determined by loW. <br /> <br />(b) ApplJ.cant shc~ll apply for any special use permits or rights- <br />of-way, as t~he case may be, i l' the same a t"e required by law <br />for t.he use of pUblic re.sourc:(~s conternpJ.'3.ted by the subject <br />application fJnd shall ilbide by t.he conditions set forth <br />therein. <br /> <br />2. The parties hereto consent to the det.ermination of this matter by <br />the Referee pursuant to applicilblc statut.es, .Jnd consistent with this <br />Stipulation. <br /> <br />3. Upon the issuance of the iul:inq and entry of a decree thereon <br />consistent with this Stipulation, the opposition of t.he United States of <br />America herein shall be deemed to have been wi.thdrA.wn. <br /> <br />As a _result of the ilqreement ilnd stipulat:ion the application was <br />again referred to the W{jter Referee for Water Division No.5 on September <br />12, 1977. <br /> <br />The Referee does therefore conclude that the above entitled i'lpplica- <br /> <br />cation should be granted and that 121 acre feet of water are hereby awarded <br /> <br />to Pa\,mee Lake, for the purpose of maint:.lininq a minimum lilke level as re- <br /> <br />quired to preserve the natural environment to a reasonablp. degree, with <br /> <br />appr.opriation date of the 17t.h day of Milrch, 1976, absolutely and uncondi- <br /> <br />tionally; subject, however, t.o all earlier priority rights of other.s and to <br /> <br />the integra tion and tabula tic.n by the Division ]:;ngineer of such priori ties <br /> <br />and changes of rights in accordance with li'lw, and further subject to the <br /> <br />terms and conditions of the Stipulation clS set. f.orth in par<3graph 12 above. <br /> <br />It is accordingly ORDERED that this ruling sh<'lll be :filed with the <br /> <br />Water Clerk and shall become effective upon such filing, subject to Judicial <br /> <br />revievl pursuant to Section 37-92-304 CRS 1973.. <br /> <br />It is further ORDERE:D th<'lt C) copy of" this ruling shall be filed with <br /> <br />the appropriate Division Engineer and the Stilte P.ngineer. <br /> <br /> <br />Done at the City of Glenwood Springs, Colorado, this 31 ~: day of <br /> <br /><i1A1(J,Q~ '( <br /> <br />, 1978 <br /> <br />no pro1.p:c;t '.'::1:3 filnll In 1')':,"" 11]"lltr>;' <br />, \.
