The above entitled appli.cation \vas filed on June B 1

1976, and Was referred to the. undi=rsign~d as Water Referee

for Hater Division iiIo. 5, State of Colorado, by the ~.:rater

Judge of said Court on the 25th day of June, 1976, in

accordance with Article 92 of Chapter 37, Colorado Revised

Statutes 1973, known as The Water Right Determination and

Administration Act of 1969.

And the undersigned Referee having made such investi-

gati.ons as, are necessary to determine \\7hether or not the

statements in the application are true and having become

fully advised with respect to the subject matter of. the

application does hereby make t.he following determination and

ruling- as the Referee in this matter, to-wi-t:

2. The name of the structure involved is Lower
Frying Pan Lake.

3. The name a.nd address of the claimant is The
Colorado Water Conservation Board) 823 State Cen-tennial
Building, 1313 Sherman Street, Denver, Colorado.

4. The source of the water is the Fryin<; Pan River.

5. The lake is located at 39Q12'io.i north latitude
and 106030'50" \\7est longitude. This is in an unsurveyed
tOi\lnsbip. Sectional projections indicate that the lake is
located in Section 2, T. 10 S., R. 82 W. of the 6th P.M.

and longitude and the sectional description, the description
by latitude?- and longitude will take precedence.
