JUDGMENT AND DECREE

THIS MATTER came on to be heard this day upon the
Referee's Report and Ruling, The Court finds that the appli-
cation for adjudication was filed on December 30, 1977; that
the Referee's Report and Ruling granting the hereinafter
described surface water right to applicant was entered on
September II, 1979, and served as provided by law; that no

protest has been filed and that the time for filing protests

has expired; and that the Report and Ruling of the Referee

should be confirmed and approved and the indicated water right

granted,

THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED that

the Report and Ruling of the Referee herein be, and the same

hereby is. confirmed and approved and that the applicant is

hereby granted the indicated water right and priority as follows:

1, That the applicant's name and address is: The

Colorado Water Conservation Board, 1313 Sherman Street, Denver,

Colorado

80200.

2. The name of the lake or reservoir is Upper Sand
Creek Lake Reservoir, located at 370 56' 25" North Latitude and
r;;o 30' OS"\west Longitude, in Saguache County, and that the
source of the water running into said lake is Sand Creek, a

tributary of the San1 Creek ,

3. That said Upper Sand Creek Lake is hereby granted

an absolute water storage Light for 1030 acre feet of water with

an appropriation date and a priority date of January 19, 1977,

for the purpose of mair.ta~_'._.ing the minimum level in such lake as
