The above entitled ~pplicatior1 was filed on June 8,

1976, and was referred to the undersigned as Wat~er Referee

for Water Division No. S, State of Colorado, by the Water

Judge of said Court on the 25th day of June, 1976, in

accordance with Article 92 bf Chapter 37, Colorado Revised

Statutes 1973, known as The Water Right Determination and

Administration Act of 1969.

And the undersigned Referee having made such investi-

gations as are n~cessary to determine whether or not the

statements in the application are true and having become

fully advised with respect t.o the subject mat-ter of the

application does hereby make -the followin9 determination and

ruling as the Referee in this matter, to-wit:

1. The statements in the application are true.

2. The name of the structure involved is Carter

Lake.

3. The name and address of the claimant is The
Colorado Water Conservation Board, 823 St2.te Centennial
Building~' 1313 Sherman Street, Denver, Colorado.

4. The source of the water is Cart~r Creek, tributary
to the Fryin9 Pan River.

5. The lake is located at 39022120'1 north latitude
and 106Q32130" west longitude. This is in an unsurveyed
tm.,rnship. S€'ctional projections indicate that the lake is
located i3 section 10, T. 8 S., R. 82 W. of the 6th P.M.

If a conflict exists bet\'leen the description by latitude
and longitude and the sectional description, the description
by latitude and longitude will .t_ake precedence.
