5. That the Colorado Water Conse.rvation RoaX'd, as the.

applicant herein1 agrees to accept as the designation of the

natural water elevation in said Rainbow Lake to be the base

of the large rock pictu,ed in the U. S. For.est Service permit
datcd October 15, 1940. Said rock shall be further described
and design~ted by the ~ttac.hment or a large brass (or other
metal) cap thoreto hy members of the staf.f of the Colorado

Oivision of Hildlife. and the. Calprado Water: Consej~v.a.tion Board

in conjunction with members of the Lake C:Leek Water Users

Association_ Said brass cap shall he appropriately inscribed

wi.t.h mar.kIngs idet\tHyIng its purpose.
6. That it\ rccognition of the foregoing agrcemcnt as

to tho specific location and identification of the exact water

lcvol to be maintained in 'Rainbow Lake as the natural minimlun

water level of said lake., the opponent, Lake. Creek Hater Users

Association, agrees to the withdrawal of its Statement of

OppositJ.on and speciHcally waives l.ts right to object now and

in the future to the awarding of an absolute decree to the

Colorado Water Conse.rvation Bos:t:'d for a minimum lake level

necessary to preserve the natural environment to a r~asonable

degree.

7. That in order to carry out the foregoing stipulated

agreement, the parties hereto agree that the Water Referee
