RULING OF REFEREE

Pursuant to Order of Referral filed and entered in the

above case on May 21, 1976, the undersigned Water Referee,

having investigated the matter of the application on file

herein, hereby makes the following findings and ruling thereon:

FINDINGS OF FACT

1. 'fhat the said application was filed on May 21, 1976.

2. 'l'hat the Water Clerk caused publication of such filing

as provided by statute; that the time for filing St~atements of

Opposition expired on the last day of July, 1976, and that none

has been filed.

3~ That the said application concerns a natural lake

located in custer County, Colorado, and used for such minimum

floW's as are required to preserve the natural environment to

a reasonable degree; and the claim for appropriation is made

under the provisions of CRS 1973, 37-92-102 (3), 37-92-103 (3),

(4) and (10).

4. 'l'hat Applicant has furnished acceptable proof as to

claims made.

IT IS, 'l'HEREFORE, ORDERED AS FOLLOI-'is: That Applicant be,
