<br />RULING OF HEFEREE
<br />
<br />The above entitled application was filed on June 8,
<br />
<br />19761 and was referred to the undersigned as Hater Referee
<br />
<br />for Water Division No.5, State of' Colorado, by the \'later
<br />
<br />Judge of said Cour.~ on the 25th day of June, 1976, in
<br />
<br />accordance with Article 92 of Chapter 37, Colorado Revised
<br />
<br />Statutes 1973, Known as The Water Right Determination and
<br />
<br />Administration 11.ci: of 1969.
<br />
<br />And the undersigned Referee having made such investi-
<br />
<br />gat ions as are necessary to determine whether or not the
<br />
<br />statements in the application are true and having become
<br />
<br />fully advised with respect to the subject ffiiltter of the
<br />
<br />application doe~) hereby make the following determination and
<br />
<br />ruling as the Referee in this matter, to-wit:
<br />
<br />1. The statements in the application are crue.
<br />
<br />2. The name of the structure involved is Josephine
<br />
<br />Lake.
<br />
<br />3. T~e name and address of the claimant is The
<br />Colorado Water Conservation Board, 823 State Centennial
<br />Building, 1313 Sherman Street:, Denver, Colorado.
<br />
<br />4. The source of the water is Last Chance Creek,
<br />tributary to the Frying-Pan River.
<br />
<br />_ 5. The lake is located 2lt 39022'50" north l2ltitude
<br />and 106033'3011 west longitude. This is in an unsurveyed
<br />township. Sectional projections indicate that the Jake is
<br />located in Section 4, T. 8 S., R. 82 W. of the 6th P.M.
<br />
<br />If a conflict exists between the description by latitude
<br />~nd Jongitude and the sectional description, the description
<br />by latitude and longitude will take ~recedence.
