in accordance with Article 92 of Chapter 37, Colorado Revised Statutes 1973,

known as The \Vater Rights Determination and Administration Act of 1969.

And the undersigned Referee having made such investLgations as are

necessa.ry to determine whether or not the statements in the application are

true and having become fully advised \vith respect Lo he subject matter of

the appllcation does hereby wake the following determination and ruling as

the Referee in this matter, to-.wit:

1. The statements in the application are true.

2. The name of the structure is Yule Lake No.4.

3. The name of the c.laimant and address is The Colorado Water Con-
servation Board; 1845 Sherman Street; Denver, Colorado.

4. The source of the \-vater is an unnamed tributary of Yule Creek,
tributary to the Crystal River.

S. The lake is located at 390 01' 20" North Latitude and 1070 08'
lO" \-lest Longitude. 'fhts is in an unsurveyed tmIDship. Sectional projec-
tions indicate that the lake is located in Secti.on 8, T.12,S., R.87W. of the
6th P.H.

If a conflict exists betlN'een the description by latitude and longi-
tude and the sectional descript.ion, the description by latitude and longi-
tude will take precedence.

6. The use of the water is to maintain the minimum lake level as re-
quired to preserve the natural environment to a reasonable degree.

7. The date of initiation of appropriat:ion is January 14, 1976.

8. The \:otal capacity of the lake is 29 acre feet.

9. The \-vater 'Nas first applied to the above beneficial use on
.January }l-+, 1976, by action of The Colorado t-later Conservati.on Board under
the provislons of C.R.S. 1973, 37-92-102(3), 3"1-92-103(3), (t.) and (1.0).

10. This approprtation is made under the provisions of C.R.S. 1973,
37-92-102(3) and 37-92-103(3), (4) and (10), knovm as Senate Bill 97, signed
into law April 23, 1973.
