<br />ferred to the undersigned as Water Referee for Water Division No.5, State of

<br />Colorado, by the Hater Judge of said Court on the 25th day of June, 1976, in
<br />accordance \Vith Article 92 of Chapter 37, Colorado Revised Statues 1973, kno,;o

<br />4. The source of the water is an unnamed tributary of the Hiddle Fork
<br />'of Homestake Creek, tribut~ry to Homestake Creek, tri~utary to the Eagle
<br />River~
<br />
<br />5. The lake is located at 390 21' 00" North La'titude and 1060 29'
<br />30" ".;est Longitude. This is in an unsurveyed to,mship. Sectional projections
<br />indicate that the lake is located in Section 18, T.8S., R.82\-l. of the 6th P.H.
<br />
<br />If a conflict exists bet\Veen the description by latitude and longitude
<br />and the sectional description, the description by latitude and longitude
<br />will take precedence.
<br />
<br />6. The use of the h'ater is to maintain th2 minimum lake level as re-
<br />quired to preserve the natural enviroTh~ent to a reasonable degree.
<br />
<br />7. The date of initiation of appropriation is January ,14, 1976.
<br />
<br />8. The total ca~acity of the lake is 80 acre feet.
<br />
<br />9. The water \Vas first applied to the above beneficial use on
<br />Janua-ry 14, 1976, by action of The Colo'cado ~';ater Conservation Board under
<br />the provisions of C.R.S. 1973, 37-92-102(3), 37-92-103(3), (4) and (10).

<br />10. This appropriation is made under the provisions of C.R.S. 1973,
<br />37-92-102(3) and 37-92-103(3), (4) and (0), kno>m as Senate Bill 97, signed
<br />into la\-1 Apri.l 23, 1973.
