ferred to the undersigned as Water Referee for Water Division No.5, State of

Colorado, by the Water Judge of said Court. on the 25t.h day of June, 1976, in

accordance with Article 92 of Chapter 37, Colorado Revised Statutes 1973,

4. The sourCe of the Hater is an unnamed tributary of Homestake Creek,
tributary to the Eagle River.

5. The lake is lo<:ated at 39022'35" North Latitude and 106025'45"
\Jest Longitude. This is in an unsurveyed tOHnship. Sectional projections
indicate that the lake is located in Section 3, T.8S., R.81W. of the 6th
P.M.

If a conflict exists betlveen the description by latitude and longi-
tude and the sectional description, the description by latitude: and longi-
tude Hill take precedence"

6. The use of the 1;vater is to maint.ain the Etinimum lake level as re-
quired to preserve the natural environment to a reasonable degree.

7. The date of initiation of appropriation is January 14, 1976.

8. The total capaeity of the lake is 90 aCre feet.

9. The lVater was first applied to the above beneficial use on
January 14, 1976, by action of The Colorado Hater Conservation .Boa!:'d under
the provisions of C.R.S. 1973, 37-92-102(3), 37-92-103(3), (4) and (10).

10. This appropriation is made under the provisions of C.R.S. 1973,
3/-92-102(3) and 37-92,-103(3), (4) and (0), known as Senate Bill 9/, signed
into law April 23, 1973.
