<br />8. The sur-face elevation of the lalce is 11/094 feet, and
<br />the total capacity of the lke is 1.35 acre feet.

<br />9. The wa~er was first applied to the above bebeficial use
<br />On March 17, 1980, by action of the Colo~ado Water Conservation
<br />Board under the provisions of C.R.S. 1973, 37-92-102(3},
<br />37-92-103 (3), (4) and (10)..

<br />10. This appropriation is made under the provisions of C.R.S.
<br />1973, 37-92-102(3) and 37-92-103(3), (4\, and (10), known 1\S
<br />Senate Sill 97, signed into law April 23, 1~73..
<br />
<br />The Referee does therefore conclude that the above entitl~d
<br />
<br />application should bo granted and that 1.35 acre feet of water,
<br />
<br />having a lake sllrface level of 11/094 feet are hereby awarded to
<br />Mexican cut! Natural Pond NO.8, for th~ purpose of maintaining
<br />a minimum lake level as reqt\ired to pl:'l:::se-rve. the natural environ-
<br />
<br />ment to a reaso~able degree I with appropriation date of March 17,
<br />
<br />1980, abolutely and unconditonally; subject, however 1 to a.ll
<br />
<br />earlier priority right5 of others and to the integration and
<br />
<br />tabulation by the Division Engineer of such priorities and
<br />
<br />changes of rights in accordance with law.

<br />It i5 ac~ordingly ORDERP.D that this rUling shall he filed

<br />with the W~ter Clerk and shall become ~ffectiv upon such filing,

<br />subject to Judici~l review pursuant to Section 37-92-J04 CRS 1973.
