<br />Tllis appropriation is made pursuant to C.R.S. 1973,
<br />37-92-102(3) and 37-92-103(3) and (4), The purpose
<br />of this appropriation by the St~ate of Colorado is
<br />to insure the preservation of a minimum lake level
<br />to protect the natural environment to a reasonable
<br />degree.
<br />
<br />8. The Applicant, by Stipulation, does not acknowledge at this
<br />time Llny rights to wal:cr by HIe United States of America, hut in the
<br />future if the United States of America shall seek appropriate judicial
<br />determination of uny cluimcc1 water righc::s in the watershed involved
<br />herein, the Applicant stipulates and agrees that -its right shall be
<br />subject to any adjudicated senior right of the United States of America.

<br />9. The priority herein awarded said Upper MiChigan was filed in
<br />the \'later Court in the year of 1977 and shall be administered as having
<br />been filed in that yeRr; and shall be junior to all priorit:ies filed in
<br />pr,~vious years. As between all rights, filed in the same calendar
<br />year, priorities shall be determined by historical dates of approp:::i-
<br />a tion and not a ffected by the datr-.! of entry of rUling.
