Colorado. hereinafter termed "RMBL", <br /> <br />and the State of Colorado by and through the Department of <br /> <br />Natural Resources hereinafter termed "the department," and <br /> <br />the Colorado Water Conservation Board hereinafter termed <br /> <br />"the board," both located at 1313 Sherman Street, Denver. <br /> <br />Colorado 80203. <br /> <br />WHEREAS, RMBL owns water rights to certain ponds locat- <br /> <br />ed in what is commonly known as the Mexican Cut area of <br /> <br />Gunnison County, Colorado. being in Township 12 South. Range <br /> <br />87 West, of the 6th Principal Meridian, more particularly <br /> <br />described on the attached exhibit IIA" which were decreed by <br /> <br />the Wa~er Court, Water Division No.5, November 6, 1972 <br /> <br />with an appropriation date of July 1, 1932 in case No. W566 <br />-------- <br /> <br />through W563; and <br /> <br />WHEREAS. RMBl desires to lease said water rights to <br />~------.~..~---~-,- <br />the board on a long term basis. in order to allow the board <br />__...___.~'___~u_-_.~.,_'_._____. <br /> <br />to manage said rights and to file on said water rights for <br /> <br />minimum lake level decrees, for the purposes herein described. <br /> <br />pursuant to C.R.S. 1913. 37-92-102 and 103; and <br /> <br />WHEREAS, the department is authorized to identify and <br /> <br />protect certain natural areaS in Colorado which serve as <br /> <br />examples of tne native condition in studies relating to <br /> <br />air, water and soil quality and habitat prOductiVity; and <br /> <br />W~EREAS, the board is authorized to make applications <br /> <br /> <br />for water rights to preserve the natural environment to a <br /> <br />reasonable degree; and <br /> <br />WHEREAS, the parties desire to promote the continued <br /> <br />use of the subject sources for piscatorial, non-manipulative <br /> <br />biological research and teaching, wildl ife procreation and <br /> <br />-I 1 .IIY 3/" I <br />flu" , <br /> <br />0/" ,p;-.S / <br /> <br />\ <br />} <br /> <br />
