(a) The'Property contains a unique' serie~ of glaGiat shelf ponds
containing. a variety of natural ecosystems fcr' comparative
bicl-ogical studies;' and

(b) The Prcperty contains representative sample~ of spruce-fir and
.alpine p~ant c:o~unities; and

. (c) The Property contains ~dditional scientific attributes as
described in Exhibit B, att-ached he'reto and irtc:()rpo~ated

with, TNC as a research 'pre'serv'e ,to: cO'n,ti'fiue efforts to minimize'
the effects of researeh and'educational'activities~ to maintain

As a tesult of these attributes, the Prcperty provides, ampng other

benefits, the following benefits:

, (a) It' fierves as an example o,f the native condition in studies
relating ta a.lr~, water, and scil' Qua.11ty ancl: habitat productivity;
and

(b) It s'er'Ves as resource material .frcm which .new knowledge may
be derived 'and as a reservoir 'Of g,enetlc',materia.l which has
present and future value to ,scie,ocifie inqu.1ry;', and

(c) It serves as an 'Outdoor' c18:ssr-oom and laboratory far sc'ie'tltif-ic
study.

3. Ri~hts and Duties 2! the Department. The Department shall list. the

Prcperty as a des~gnated natural area. of the Colcrado Natural Areas SyscemJ The

Department ,shall provide. the Own~r with a Cer,tificate indicating said desig:q8tion.

Further, this designation evidences the desire of the Department that ~he Property

he protected from impacts adversely affecting the a~tributes for which the Property

was designated. To. the extent that it has ,the authority to do'so; the Department

sh.all not publish any infor.mation- conce~n1ng the, lccation of the "Property other

than the name of the C~unty in which it 1s ~ccated.

(a)

Access. The Department has no authority to grant access to
the property withcut the.mutual co~sent of the OWner or
Lessee. Consent may be gIven when access would be consistent
with and promcte the purpcses of this Ag~eementa

(b)

Inspection. The Department shall,have the right to inspe~t the
Property frcm time to. time tQ confirm that it is being used solely
for the purposes stated in paragraph' 4a The Department shall '
give the Owner or Lessee ten (10) days prior notice of the date
and 'time it intends to inspect 'the, Property.
