Rijl'hts and Duties of the Department: The Board shall list the <br />Property as a designated natural area of the Colorado Natural Areas <br />Program and shall provide the Conservancy with a Certificate of <br />Designation and a signed copy of the Articles of Designation <br />indicating said designation: This designation evidences the desire <br />of the Board that the Property be protected from impacts adversely <br />affecting the attributes for which the Property is designated: To <br />the extent that it has the ~uthority to do so, the Board shall not <br />publish any information concerning the location of the Property other <br />than the name of the County in which it is located. <br /> <br />A: The Division has no autbority to grant access to the Property <br />without the mutual consent of the OWner and Lessee: Consent may <br />be given when access would be consistent with and promote the <br />purposes of this Agreement: <br /> <br />B. The Division may visit the Property at any time to evaluate <br />current uses and conditions for consistency with the Program; <br />provided that the activities of the Lessee of the Porperty are <br />not interfered with: The Department will give advance notice to <br />the Conservancy and the Lessee of any visits: Following the <br />visit, the Division will consult with, and provide any resulting <br />reports to, the Conservancy: <br /> <br />4: <br /> <br />Rights and Duties of the Conservancy: The management of the Property <br />slia11 be the responsibility of the Conservancy; which agrees to <br />preclude all development of the Property except as deemed necessary <br />to protect the area for the purpose for which it is established and <br />to protect the natural features of the Property: <br /> <br />A: The Conservancy and the Lessee shall use the Property solely for <br />its purposes, including but not limited to education and <br />conducting biological investigations. <br /> <br />B: User-access to the Property will be by permission of the <br />Conservancy and the Lessee; which permission may be granted or <br />withheld at their sole discretion: <br /> <br />c: No hunting or camping will be allowed within the Property: <br /> <br />Page 3 of 5 pages <br />
