<br /> <br />. <br /> <br />. <br /> <br />COLORADO NATURAL AREAS PROGRAM <br />DEPAR1MENT OF NATURAL RESOURCES <br />STATE OF COLORADO <br />MEXICAN cur NATURAL AREA <br />ARTICLES OF DESIGNATION <br />(Amended and Restated) <br /> <br />These Articles of Designation, made on the 3rd of November, 1978, and amended <br />on May 8, 1981, and further amended this day of , 1989 by <br />and between the State of Colorado; acting by and through the Department of <br />Natural Resources, Division of Parks and Outdoor Recreation, Colorado Natural <br />Areas Program; 1313 Sherman Street; Room, 618, Denver, Colorado 80203; <br />hereinafter the Division, and The Nature Conservancy, a non-profit District of <br />Columbia corporation, 1815 North Lynn Street, Arlington, Virginia 22209, <br />hereinafter the Conservancy; the Colorado Water Conservation Board; Department <br />of Natural Resources, 1313 Sherman Street; Room 723, Denver, Colorado 80203, <br />hereinafter the Board; and, the Rocky Mountain BUlogical Laboratory; Gothic, <br />Colorado 81224, hereinafter RMBL: <br /> <br />WHEREAS, the Conservancy owns and RMBL manages certain lands; including <br />certain patented mining claims which include the accompanying surface rights, <br />as a biological preserve and totaling 960 acres as described in Exhibits A-D, <br />attached hereto and incorporated herein by reference, and known as the Mexican <br />Cut preserve situated in the County of Gunnison, State of Colorado, <br />hereinafter the Property; and <br /> <br />WHEREAS; the Conservancy acquires and protects exemplary examples of <br />Colorado's natural heritage; and <br /> <br />WHEREAS; the Conservancy has declared that the best use of the Property is <br />that it be preserved and protected as a natural area; and <br /> <br />WHEREAS; the Division is authorized to conduct and administer the provisions <br />of the Colorado Natural Areas Act as set forth at C.R.S. 33-33-101; et s~:; <br />and - <br /> <br />WHEREAS; the Natural Areas Act established a statewide Colorado Natural Areas <br />Program, hereinafter the Program; to provide a means by which specific <br />examples of Colorado's natural features and ecological phenomena can be <br />identified; evaluated, and protected through a statewide system of designated <br />natural areas; and <br /> <br />WHEREAS; the Act established a Natural Areas Council, hereinafter the Council; <br />which advises the Board of Parks and Outdoor Recreation (hereinafter the <br />Board) on the administration of the Program and which recommends the <br />designation of Colorado Natural Areas by the Board; and <br /> <br />Page 1 of 5 pages <br />
