Part 3 of article 15 of title 25, Colorado Revised <br />Statutes, is amended BY THE ADDITION OF THE FOLLOWING NEW <br />SECTIONS to read: <br /> <br />. <br /> <br />SUBPART 2 <br />COLORADO UNIFORM ENVIRONMENTAL COVENANTS ACT <br />25-15-316.5. Short title. THIS SUBPART 2, SECTIONS25-15-3165 <br />TO 25-15-328, SHALL BE KNOWN AND MAYBE CITED AS THE "COLORADO <br />UNIFORM ENVIRONMENTAL COVENANTS ACT", <br />25-15-317.5. Definitions. As USED IN THIS SUBPART 2, UNLESS <br />THE CONTEXT OTHERWISE REQUIRES: <br />(I) "ACTIVITY AND USE LIMITATIONS" MEANS RESlRICTIONS OR <br />OBLIGATIONS CREATED UNDER THIS SUBPART 2 WITH RESPECT TO REAL <br />PROPERTY, INCLUDING AN ENVIRONMENTAL USE RESTRICTION. <br />(2) "AFFECTED LOCAL GOVERNMENT" MEANS EVERY COUNTY, CITY <br />AND COUNTY, OR MUNICIPALITY IN WHICH REAL PROPERTY SUBJECT TO AN. <br />ENVIRONMENTAL COVENANT IS LOCATED, <br />(3) "COMMON INTEREST COMMUNITY" MEANS A CONDOMINIUM, <br />COOPERATIVE, OR OTHER REAL PROPERTY WITH RESPECT TO WHICH A <br />PERSON, BY VIRTUE OF THE PERSON'S OWNERSHIP OF A PARCEL OF REAL <br />PROPERTY, IS OBLIGATED TO PAY PROPERTY TAXES OR INSURANCE <br />PREMIUMS OR FOR MAINTENANCE OR IMPROVEMENT OF OTHER REAL <br />PROPERTY DESCRIBED IN A RECORDED COVENANT THAT CREATES THE <br />COMMON INTEREST COMMUNITY. <br />(4) "ENVIRONMENTAL COVENANT" MEANS AN INSTRUMENT <br />CREATED UNDER SECTION 25-15-321 THAT ARISES UNDER AN <br />ENVIRONMENTAL RESPONSE PROJECT AND IMPOSES ACTIVITY AND USE <br /> <br />. <br /> <br />. <br /> <br />-4- <br /> <br />SB05-246 <br />
